1. Scope of application of the GTC

For the business relationship between Presentera UG (haftungsbeschränkt) (hereinafter referred to as Presentera) and you as a user, the following General Terms and Conditions (hereinafter referred to as "GTC") apply exclusively.

The website www.lets-save-the-planet.com, www.alive.blue, www.we-are-alive.net and our apps called "Let's Save The Planet!" or "Alive", hereinafter also referred to as "Media", are offers of Presentera.

The use of the media, as well as the use of the services offered are subject to these General Terms and Conditions. The terms and conditions available on the websites at the time of the visit or registration apply. By using the media or registering, you declare your complete agreement with these General Terms and Conditions.

3. General notes on offers and orders

Calculator for estimating CO2 emissions:
We offer a free calculator to estimate your CO2 emissions and carbon footprint. To simplify matters, we use the term CO2 in these GTC and in our communication. In technically correct terms, we use this to refer to CO2e, i.e. CO2 and other climate gasses whose impact is converted into CO2 equivalents. Estimates are based on your answers about your lifestyle and consumption behavior as well as data from scientific studies and average values of the country you live in. If data is (partially) not available for your country, individual lifestyle areas, or use cases, we may make our own calculations or estimates. Since not every consumption decision is recorded and also the calculation of so-called CO2 emission factors does not happen in a perfect world, these are only estimated values. We do not guarantee that our estimated values correspond exactly to your personal CO2 emissions. We may make optimizations to our calculation model as we gain new insights. The more information you share with us about your lifestyle and consumption patterns and changes, the more accurate the estimate potentially becomes. -
Recommendations for personal CO2 reduction:
We offer recommendations to help you reduce CO2 emissions, both in relation to your personal consumption decisions and to products and services. Based on an estimation of your carbon footprint as well as individual information, we try to offer you recommendations that are as relevant as possible and that you can use to reduce your CO2 emissions with a focussed approach. However, we cannot guarantee their effectiveness, as this may depend on many factors in your specific case. Please critically assess for yourself whether the respective recommendation makes sense in your case. For this purpose, we usually provide you with supporting information and links to sources. With each of our recommendations, our intention is to show you a way to reduce your CO2 emissions for the long-term and in a sustainable way. Especially when presenting products and services, we have a commercial interest at the same time. Part of our business model is that we present products and services to you and mediate purchases. In doing so, we are paid for various services, e.g. the presentation of services, clicks on links, the mediation of information requests, the mediation of product tests, or for sales from our cooperation partners. When selecting products and services to present, we make sure that they potentially lead to lower long-term CO2 emissions. It is important that you check whether this is also the case in your own life situation with a high probability. The information provided on our media is for your non-binding guidance only and does not constitute a legally binding offer by Presentera. Contracts for the delivery of products or services can only be concluded between you and the respective provider. Presentera does not become a contracting party. Excluded from this are offers that are described in these GTC as concrete offers of Presentera, e.g. the mediation of the support of climate protection projects. We rely mainly on information from partners and third parties (e.g. manufacturers) as well as public information sources. In individual cases, there may be deviations with regard to prices, availability and delivery times of products and services. Please always check the information directly with the respective supplier. Due to the amount of information to be processed, we cannot exclude the possibility of errors. Therefore, we cannot guarantee the accuracy of the information provided. We do not have the capacity to consider all providers and offers available on the market. The selection of displayed recommendations is at the sole discretion of Presentera and our partners. The displayed recommendations are only meant to give you an overview and do not claim to be complete. Presentera reserves the right to remove individual products and services at any time without prior notice. -
Optional paid support for climate protection projects:
We offer you the opportunity to support our portfolio of climate protection projects. The projects we work with, directly or indirectly, aim to either prevent CO2 emissions or to pull CO2 emissions out of the atmosphere and store them safely and for as long as possible. We use at least 85% of the contributions after deduction of value added tax (VAT), to support the projects. The projects commit to us to use the money for climate protection and to achieve corresponding CO2 reductions, or sell us certificates for CO2 reductions already achieved. We offset the emissions estimated for you in the respective month proportionally with the CO2 reductions by our project partners.
Based on the estimate of your CO2 emissions, we will make a proposal for your monthly contribution. To make it as convenient as possible for you, you can sign up for a paid monthly subscription with us. You can pause or cancel the subscription at any time in the app or on the website, effective the next month. Each time you notify us in the app or on our website of a change that reduces your CO2 emissions, we will automatically reduce the contribution proportionally starting the following month. You might be able to adjust the monthly contribution to offset only a portion of your estimated CO2 emissions, or reduce additional CO2 emissions. -
You are responsible for ensuring that the information you provide is accurate and that any changes are communicated to Presentera if they are necessary for the performance of the contract. In particular, you are responsible for ensuring that the email and delivery addresses you provide are accurate and that any obstructions to receipt for which you are responsible are taken into account accordingly (e.g. by checking the spam folder of the email software used).
4. Order process and conclusion of contract

By clicking on the button that concludes the order process, you submit a binding offer to Presentera to purchase the services listed above.
5. Contract text and contract language

Presentera saves the text of the contract and provides it to you in text form (e.g. by email). You can print the contract text before submitting the order to Presentera by using the print function of your browser or the save function for websites in the last step of the order process.

The contract language is German. Contracts can be concluded in this language.
6. Information about prices

Unless otherwise stated, all prices are total prices including the applicable statutory value added tax (VAT).

Downloading and using our apps or website may incur data transfer costs in accordance with your contract with your Internet access provider.
7. Payment methods and terms

When using financial institutions and other payment service providers, the terms and conditions and data protection notices of the payment service providers also apply with regard to payment. You are requested to observe these regulations and notes as well as information within the framework of the payment process. This is particularly because the provision of payment methods or the course of the payment process may also depend on the agreements between you and financial institutions and payment service providers (e.g. agreed spending limits, location-restricted payment options, verification procedures, etc.).

You shall ensure that you meet the requirements incumbent upon you, which are necessary for successful payment by means of the selected payment method. This includes, in particular, sufficient coverage of bank and other payment accounts, registration, legitimation and authorization with payment services and confirmation of transactions.

If a payment is not made or reversed due to insufficient funds in your account, the provision of incorrect bank details or an unjustified objection on your part, then you shall bear the fees incurred as a result, provided that you are responsible for the failed or reversed booking and, in the case of a SEPA transfer, were informed of the transfer in good time (so-called "pre-notification").

8. Subscriptions

"Subscription" means the regular purchase of services by you under an ongoing contractual relationship (also referred to as a "Subscription Agreement") over a fixed period of time.

A subscription agreement obligates Presentera to use at least 85% of a monthly contribution, after deduction of sales tax (VAT), to support climate change mitigation projects.

You can pause or cancel the subscription at any time in text form (e.g. by email) or in the app or on the website with effect from the next month.

The right to extraordinary termination of the subscription contract is reserved in accordance with the statutory provisions.

The subscription period is one month.

The subscription contract is automatically extended by one month unless it has been effectively terminated.
9. Copyrights and rights of use

By submitting content (e.g. profile pictures or ratings) you grant Presentera the simple, gratuitous, unlimited transferable right to use the submitted contribution. This also includes the right of editing and translation, as long as the intellectual character of the work is preserved. The author waives the right to be named as author. Furthermore, you indemnify Presentera from any claims made by third parties due to the posting of his text and image contributions. You assume the costs of the necessary legal defense, including court and attorney fees, incurred by Presentera in defending against these claims.
10. Cancellation policy

The information on the right of withdrawal for consumers is derived from Presentera's cancellation policy.

The right of withdrawal does not apply to consumers who have their domicile, habitual residence or delivery address at the time of conclusion of the contract and delivery outside a Member State of the European Union (EU) or the European Economic Area (EEA) and do not belong to any of these Member States.

11 Warranty and liability

The warranty (liability for defects) shall be governed by statutory provisions subject to the following provisions.

Presentera is liable for damages without limitation, as far as the cause of damage is based on intent or gross negligence. Furthermore, Presentera is liable for the slightly negligent breach of essential obligations, the breach of which endangers the achievement of the purpose of the contract, for the breach of obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the compliance with which you regularly rely (cardinal obligations) or in the case of agreed warranty promises. In this case Presentera is only liable for the foreseeable, contract-typical and expectable damage. Presentera is not liable for the slightly negligent breach of obligations other than those mentioned above. The above limitations of liability do not apply in case of injury to life, body and health, for a defect after acceptance of a guarantee for the quality of the product and for fraudulently concealed defects. The liability according to the product liability law remains unaffected. As far as Presentera's liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents. For the rest, claims for damages on their part are excluded. The above liability regulations also apply to claims for damages on their part within the scope of Presentera's legal warranty.

12. Dispute resolution and consumer dispute resolution
